If the client has never filed a tax return before, can use the procedure called “the Streamlined Procedure”. This procedure involves reporting up to three years back in the U.S. and attaching a statement that the client was unaware. Additionally, account information has been shared for the past six years. The advantage of using a disclosure procedure is that your client will then not be fined for failure to file or late filing, however, there may be a penalty if the return is sent incorrectly or incompletely.
If the client wishes to renounce his or her citizenship, he or she must file a return up to five years back in addition to the year of cancellation and provide bank account information up to six years back. Terminating U.S. citizenship is irreversible and should be carefully considered.
